In 1991 On September 2, the Nagorno Karabakh Republic (NKR) declared a joint session of deputies of all levels of the Nagorno-Karabakh region and the Shahumyan region on the basis of the USSR law "On the procedure for solving issues related to the withdrawal of the Union Republic from the USSR." In particular, the declaration stated that it expresses "the will of the people, which was confirmed in the actually held referendum and the 1988-1991 decisions of the regional authorities of Nagorno-Karabakh and Shahumyan. decisions, its pursuit of freedom, independence, equality and neighborliness".

In response, Azerbaijan in 1991 On November 26, he adopted the law "On the dissolution of the Nagorno Karabakh Autonomous Region of the Republic of Azerbaijan", where in 1923 the creation of autonomy is defined as "a factor contrary to the national interests of the Azerbaijani people".

However, on November 28, the mentioned decision was recognized by the USSR Constitutional Control Committee as contradicting the USSR Constitution. According to the Constitution of the USSR, Nagorno-Karabakh was among the autonomies, which the constitutional law of the USSR considered as a manifestation of the right to self-determination, and to which the right to self-determination was reserved. Since the autonomy of the Armenians of Nagorno-Karabakh was a manifestation of the people's right to self-determination, both its dissolution and transformation (change of status) are possible only through the will of the people.

In 1991 On December 10, a referendum was held in the Republic of Nagorno Karabakh. The following question was placed on the ballot. "Do you agree that the declared Nagorno-Karabakh Republic should be an independent state, independently determining the form of cooperation with other states and associations?" Out of 132,328 eligible voters, 108,736 (82.2%) participated in the voting, 108,615 people (99.89% of voters) voted "for" independence.

In 1992 On January 6, the NKR Supreme Council adopted the NKR State Independence Declaration, thereby legally enshrining both the results of the referendum and the earlier legal acts that implemented the right of the people of Nagorno Karabakh to independently determine their political status.

In 1992 On January 8, the session of the NKR Supreme Council elected Artur Mkrtchyan, the head of the legislative body of the republic. Oleg Yesayan was confirmed as the chairman of the Council of Ministers.
